Important: These Terms & Conditions ("Terms") constitute a legally binding agreement between you ("Client," "you," or "your") and Khalsa Financial Services ("we," "our," or "KFS"). By using our services, website, or communicating with us for professional services, you confirm that you have read, understood, and agreed to these Terms.
Section 01

Acceptance of Terms

By accessing our website at www.khalsafinancial.in, contacting us via telephone, WhatsApp, email, or any other medium, or by engaging our professional services, you acknowledge that you have read and accepted these Terms & Conditions in their entirety.

If you do not agree with any part of these Terms, you must not use our services. These Terms apply to all visitors, clients, and users of Khalsa Financial Services.

These Terms apply in addition to any specific engagement letters, service agreements, or proposals signed between you and Khalsa Financial Services for particular assignments.

Section 02

Services Offered

Khalsa Financial Services provides the following professional financial and taxation services to individuals and businesses in India:

  • Income Tax Return (ITR) filing for individuals, salaried employees, self-employed professionals, and businesses
  • GST registration, GSTR-1, GSTR-3B, GSTR-9 and other GST return filings
  • TDS return filing (24Q, 26Q, 27Q) and Form 16/16A generation
  • Company incorporation (Private Limited, LLP, OPC, Proprietorship)
  • MSME/Udyam registration and business compliance
  • Bookkeeping, accounting, and financial statement preparation
  • Tax planning, advisory, and investment consultation
  • PAN/TAN application and corrections
  • NRI taxation and DTAA advisory
  • Capital gains computation and advisory

The scope of each engagement will be defined in a separate service proposal or agreement communicated to you before commencement of work. Services not explicitly mentioned in a proposal are not included in the engagement fee.

Section 03

Client Responsibilities

To enable us to provide accurate and timely services, you agree to:

  • Provide accurate information: All documents, data, and information shared with us must be true, complete, and accurate to the best of your knowledge.
  • Timely document submission: Delays in providing required documents may result in delayed filings. Khalsa Financial Services shall not be held responsible for late filing penalties arising from such delays.
  • Respond promptly: You agree to respond to our queries, requests for clarification, or draft approvals within a reasonable time (typically 48 working hours).
  • Authorization: You confirm that you are duly authorised to engage our services on behalf of yourself or the entity for which services are being sought.
  • Portal access: Where required, you agree to provide login credentials for income tax, GST, or other government portals as necessary for service delivery, or to generate OTPs on demand.
  • Compliance with law: You shall not engage our services for any purpose that violates applicable Indian laws, including but not limited to the Income Tax Act 1961, CGST Act 2017, or Companies Act 2013.
Section 04

Fees & Payment

Our service fees are communicated upfront and agreed upon before commencement of work. The following terms apply to payments:

  • Payment schedule: Fees are generally payable in full or in part (as agreed) before or upon delivery of the service. No final deliverable will be shared until outstanding fees are cleared.
  • Accepted payment methods: We accept payment via bank transfer (NEFT/IMPS/RTGS), UPI, or other methods communicated at the time of engagement.
  • Government fees: Any government fees, MCA fees, stamp duty, or other statutory charges payable to third parties are not included in our service fee unless explicitly stated. Such fees are payable by the client directly or reimbursed to us as actuals.
  • Late payment: We reserve the right to suspend or terminate services if fees remain unpaid after the agreed due date.
  • GST on fees: GST at the applicable rate (currently 18%) will be charged on our professional fees where applicable under the CGST Act 2017.
  • Price changes: We reserve the right to revise our fees. Any revision will be communicated before it takes effect and will not apply to services already confirmed and in progress.
Section 05

Accuracy of Information

Khalsa Financial Services prepares filings and documents based entirely on the information and documents provided by you. Our work is predicated on the accuracy and completeness of the data you supply.

We shall not be liable for:

  • Any errors, omissions, or inaccuracies in filings arising from incorrect or incomplete information provided by you
  • Any tax demands, penalties, or assessments arising from non-disclosure of income, assets, or transactions by you
  • Consequences of filing based on forged, fabricated, or misrepresented documents submitted by the client

We will exercise reasonable professional care and diligence in reviewing the information provided. Where we identify potential discrepancies or issues, we will bring them to your attention before proceeding.

Please Note: You are legally responsible for the content of all returns and filings submitted on your behalf. We act as your agent and professional advisor, not as the signatory authority unless a specific power of attorney is granted.
Section 06

Confidentiality

Khalsa Financial Services treats all client information with the strictest confidence. We agree to:

  • Not disclose your financial or personal information to any third party without your explicit written consent
  • Use your data solely for the purpose of delivering the agreed services
  • Implement reasonable technical and organisational measures to protect your information from unauthorised access
  • Comply with applicable data protection requirements under Indian law, including the Digital Personal Data Protection Act 2023

Exceptions to confidentiality include situations where disclosure is required by law, regulatory authority, or a court of competent jurisdiction, in which case we will notify you to the extent permitted by law.

Our employees and contractors handling your data are bound by confidentiality obligations. Data shared via WhatsApp, email, or our platforms is stored securely and is not used for marketing, resale, or any purpose other than service delivery.

Section 07

Intellectual Property

All content on our website — including text, graphics, logos, service descriptions, and design — is the intellectual property of Khalsa Financial Services and is protected under applicable Indian and international copyright laws.

You may not reproduce, redistribute, or use our website content for commercial purposes without prior written permission.

Financial reports, tax computations, and documents prepared by us on your behalf are for your personal or business use only. They may not be shared publicly or used by third parties without our consent.

Section 08

Limitation of Liability

To the maximum extent permitted under applicable law:

  • Our total liability to you for any claim arising from our services shall not exceed the total fees paid by you for the specific service giving rise to the claim in the immediately preceding 12 months.
  • We shall not be liable for indirect, incidental, consequential, or punitive damages of any kind, including but not limited to loss of profit, loss of data, or business interruption.
  • We shall not be liable for delays, failures, or penalties caused by system outages on government portals (such as the Income Tax e-filing portal or GST portal), acts of God, internet failures, or circumstances beyond our reasonable control.
  • Our advice is based on current laws and interpretations at the time of the engagement. Changes in law, judicial interpretations, or regulatory guidance after the date of our advice may alter the outcome, and we bear no liability for such changes.
Section 09

Refund Policy

We are committed to delivering quality services. Our refund policy is as follows:

  • Pre-commencement cancellation: If you cancel a service request before we have commenced any work, a full refund will be issued within 7 working days.
  • Post-commencement: If work has begun, a proportionate refund based on work completed may be offered at our discretion after deducting reasonable professional charges for time and effort expended.
  • Filed returns: Once an ITR or GST return has been filed with the relevant government authority, no refund is possible as the service has been fully rendered. Any revision or rectification would be treated as a separate service.
  • Government fees: Statutory or government fees paid on your behalf are non-refundable under any circumstances.
  • Disputes: Refund disputes must be raised within 30 days of the service delivery date. Disputes raised after this period will not be entertained.

Refunds, where applicable, are processed to the original payment source within 7–14 working days.

Section 10

Termination of Services

Either party may terminate an ongoing service engagement with reasonable written notice. The following terms apply:

  • By you: You may terminate our services at any time by written notice to us. You will be liable for fees for work completed up to the date of termination.
  • By us: We reserve the right to terminate our engagement if: (a) you provide false or misleading information; (b) you engage us for illegal purposes; (c) outstanding fees remain unpaid after notice; or (d) the professional relationship becomes untenable.
  • Upon termination, we will return all original documents provided by you. Work products and documents prepared by us, for which fees have been paid in full, will be delivered to you.
Section 11

Third-Party Services

In the course of delivering our services, we may engage or interface with third-party government portals (Income Tax, GST, MCA, etc.), payment gateways, or cloud storage platforms. We are not responsible for:

  • Outages, errors, or delays on government portals
  • Changes to government processes, portal interfaces, or regulatory requirements
  • The privacy practices or terms of third-party platforms

Our website may contain links to external websites for reference purposes. These links do not imply endorsement, and we are not responsible for the content or practices of such external sites.

Section 12

Governing Law & Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of India. Any dispute arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts located in [City, State], India.

Before initiating legal proceedings, both parties agree to make a good-faith attempt to resolve any dispute through mutual discussion or mediation within 30 days of the dispute arising.

Section 13

Amendments to These Terms

Khalsa Financial Services reserves the right to modify these Terms at any time. Changes will be posted on our website with an updated "Last Updated" date. Your continued use of our services after the posting of changes constitutes your acceptance of the revised Terms.

We encourage you to review these Terms periodically. For material changes, we will make reasonable efforts to notify existing clients via email or WhatsApp.
